Clause 6: Execution of the Service
The photographs are taken by Mr. DANIEL Romain or, in case of major impediment, by any other photographer appointed in agreement with the client.
Romain DANIEL EI makes every effort to provide high-quality images, as stipulated in the order. The content of these images is left to the artistic discretion of the photographer. Consequently, clients acknowledge that the photographs are not subject to rejection based on the client's personal taste.
Clause 7: Intellectual Property
In accordance with French law, the photographs taken during a session with the client are protected under the rules of Articles L 121-1 and the law of March 11, 1957 (Intellectual Property and Copyright Code).
Even after delivery of the digital files, the photographs remain the intellectual property of the photographer and are consequently not royalty-free.
Commercial use of the session images by the Client is not authorized and must be the subject of a new written agreement with the photographer.
Clients may not modify, retouch, or alter the delivered photographs in any way, on any medium whatsoever.
Any personal use of a photograph, whatever it may be and for whatever purpose (publication on the internet, exhibition, etc.), must at least mention the Photographer's name.
The client holds the printing and reproduction rights to the photos for private purposes only, unless otherwise agreed beforehand.
Clause 8: Image Rights
The photographer reserves the right to use the photographs he has taken to promote his business (website, social networks, exhibitions, etc.).
The client understands and accepts this.
The client may assert their disagreement at the time of signing the quote/contract.
In the event of refusal, the client cannot refuse the use of photos on which they are not recognizable. Similarly, any photo published publicly (internet, social networks, etc.) by the client may be used by the photographer.
Clause 9: Retention of Title Clause
Romain DANIEL EI retains ownership of the goods/photos sold until full payment of the price, in principal and accessories.

- or through a delivery service to the address designated by the buyer.
The delivery time indicated when registering the order is given for information purposes only and is in no way guaranteed.
Consequently, any reasonable delay in the delivery of products cannot result in the buyer benefiting from:
- The allocation of damages;
- The cancellation of the order.
The transport risk is borne entirely by the buyer.
The buyer is responsible for checking conformity upon receipt.
In the event of missing or damaged goods during transport, the buyer must formulate all necessary reservations on the purchase order upon receipt of said goods. Clause 11: Liabilities
11.1 Force Majeure
The liability of Romain DANIEL EI cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure. As such, force majeure is understood as any external, unforeseeable, and irresistible event within the meaning of Article 1218 of the French Civil Code.
11.2 Illness
Romain DANIEL EI reserves the right to postpone a photography service in case of illness.
The session will be postponed to a later date. This postponement cannot give rise to the payment of damages in any capacity whatsoever.
In the context of a wedding, the photographer undertakes to do his utmost to help the clients find another available service provider to carry out the service.
All amounts paid will then be refunded without, however, giving rise to the payment of damages in any capacity whatsoever.
11.3 Weather Conditions
In the event of degraded weather conditions such as storms, gales, heavy rain, etc., Romain DANIEL EI cannot be held responsible for the non-execution or partial execution of outdoor services initially planned in the order. No refund will be made; the session will be postponed to a later date.

The time set for the service is imperative, and any delay by the client may be deducted from the time previously agreed upon for the session.
Beyond 30 minutes of delay, the session will be canceled.
Any quote or contract signed upstream of the service acts as a firm commitment; therefore, the client must pay the full price of the service, in accordance with French law.
Clients declare that they are of legal age, pose freely for photos, and, where applicable, authorize shots of their children.
The photographer must not be hindered during his service by amateur photographers.
Children present during photo sessions remain under the full responsibility of the parents. In the event of material damage caused by the client or the child or any other person present at the place of the service and in connection with it (family or companions), these must be reimbursed in full by the client.
Clause 12: Legal Right of Withdrawal
12.1 Individual Clients
The client (non-professional) has a legal right of withdrawal of 14 days in accordance with Art. L221-18 et seq. of the French Consumer Code from the conclusion of the contract.
For any service performed within a period of less than the legal 14-day period, the client formally waives this period.
In the event of withdrawal, the amounts paid by the Client will be fully refunded within the maximum legal period of 14 days.
The client returns or restores the goods to the professional or to a person designated by the latter, without undue delay and, at the latest, within fourteen days following the communication of their decision to withdraw in accordance with Article L. 221-21, unless the professional offers to recover these goods themselves.
In accordance with Article 221-28 of the Consumer Code, the right of withdrawal does not apply to the products named herein:
- The supply of digital content not supplied on a tangible medium, the execution of which has begun, with the client's prior express consent, before the end of the withdrawal period (Art. 221-28-13°) (Example: photo retouching).
- The supply of goods made to the consumer's specifications or clearly personalized (Art. 221-28-3°) (Example: photo print, photo frame, poster).
In the event of cancellation of the booking of a photography service that has become definitive, it is recalled that in accordance with legal provisions, the deposit amount will not be refunded, except in cases of force majeure for the client.
12.2 Professional Clients
The right of withdrawal only applies to professional clients under the conditions described in Article L.221-3 of the Consumer Code (Hamon Law of March 17, 2014):
- The company must employ a maximum of 5 employees;
- The contract must be concluded "off-premises" (canvassing by a seller outside their commercial premises);
- The subject of the contract must not fall within the "scope of the main activity" of the professional.
As such, the Professional Client meeting these criteria will have the possibility of exercising their right of withdrawal under the same conditions as an individual client, as described in part 12.1 of these general terms and conditions of sale.

The withdrawal request must be made by registered mail with acknowledgment of receipt to the following address:
